MLVT Reminds Enterprises of the Self-Declared Labour Inspection Obligation for the First Semester of 2026

On 29 May 2026, the Ministry of Labour and Vocational Training (“MLVT”) issued Notification No. 017/26 on the Obligation to Implement the Self-Declared Labour Inspection through the Automation System in June 2026 (“Notification 017/26”).
The Notification reminds enterprises of their obligation to file the self-declared labour inspection for the first semester of 2026.
The filing deadline is 30 June 2026.

Background of the Self-Declared Labour Inspection Regime
The self-declared labour inspection regime was introduced by Prakas No. 358/21 on the Launching of the Self-Declared Labour Inspection Regime and the Conducting of Labour Inspections through the Automated System, dated 30 December 2021. Since January 2022, enterprises have been required to complete self-declared labour inspections through the MLVT online system.
The regime is designed to enhance the compliance culture within each enterprise, allowing the enterprise to assess its level of compliance with the Labour Law and to rectify any areas of non-compliance prior to a physical inspection by a labour inspector.

Filing Obligation and Frequency
Owners or directors of enterprises and establishments are required to complete the self-declared labour inspection report through the automated system twice per year: the first filing in June and the second filing in December.
The information in the report must also be updated before the date of any ordinary labour inspection conducted by labour inspectors. For the current cycle, the first-semester 2026 filing must be completed by 30 June 2026.

Filing Procedure
The self-declared labour inspection must be filed online through the MLVT’s system at https://sicms.mlvt.gov.kh.
Under the regime, enterprises are required to conduct self-assessments of their compliance with the Labour Law and its implementing regulations, and to provide the relevant supporting documents, prior to any physical inspection by a labour inspector.

Rectification of Non-Compliance
Where any areas of non-compliance are detected, enterprises are required to rectify them within 30 days. The self-declaration mechanism is intended to give enterprises an opportunity to identify and correct compliance gaps proactively, before they are identified through a physical inspection.

Penalties for Non-Compliance
Failure to comply with the obligations set out in Notification 017/26 may result in the enterprise’s owners or directors being subject to penalties and measures imposed by labour inspectors under applicable laws.
While no fixed penalty is prescribed specifically for late submission, administrative fines are assessed under the formula-based approach established by Joint Prakas No. 498 (2023) on labour penalties, under which the daily base wage used for calculation is KHR 80,000 (approximately USD 20), with the total fine determined by the number of penalty days applied by the inspecting officer.
The actual penalty is assessed on a case-by-case basis and may increase where non-compliance is repeated or prolonged, where additional labour violations are identified, or where the enterprise fails to cooperate with inspectors.

Implementation Considerations
Enterprises should ensure they have access to the SICMS portal, complete the self-assessment accurately, and verify that the declared information is consistent with their employment records, work permit information, payroll, and social security registrations. Given the 30-day rectification window for any detected non-compliance, enterprises are encouraged to complete the filing well ahead of the 30 June 2026 deadline to allow sufficient time to address any issues identified.
