Cambodia’s Ministry of Labor Strengthens Protections for Pregnant Workers and New Mothers

The Ministry of Labor and Vocational Training (MLVT) has recently issued a new instruction that significantly enhances the rights and protections afforded to pregnant workers and new mothers in the workplace. This instruction introduces comprehensive measures aimed at preventing discrimination and ensuring job security during this critical period (MLVT Instruction No.015 on Special Protection for Pregnant Worker/Employee as of 7th February 2025).

Key Protections Under the New Instruction
The instruction establishes several important protections:

Anti-Discrimination Provisions
Employers are prohibited from discriminating against pregnant workers in hiring decisions, contract renewals, wage increases, and other benefits.

Financial Security During Maternity Leave
All wages for maternity leave must be paid to workers before they begin their leave, ensuring financial stability during this period.
*Wage for maternity leave: half amount of average monthly wage and benefit during past 1 year

Employment Security
Employment contracts of pregnant workers or female employees cannot be suspended during pregnancy or for nine months following maternity leave, except in cases of complete suspension affecting all or part of the enterprise.

Contract Renewal
Employers are encouraged to automatically renew employment contracts for pregnant workers or mothers within one year after childbirth.

Termination Restrictions
Termination of pregnant workers or new mothers (within one year after giving birth) is prohibited except in cases involving serious misconduct.
Prior examination and approval from Labor Inspectors is required before any termination of pregnant workers or new mothers can proceed.

Enforcement and Compliance
The instruction emphasizes that non-compliance will result in penalties under applicable laws and regulations. Enterprise owners and directors are explicitly instructed to implement these protections “strictly and effectively.”
